The Federal Government has, through a ratified constitution , guaranteed unalienable rights to its citizens and to some degree non-citizens. These rights have evolved over time through constitutional amendments, legislation, and judicial precedent. Along with the rights themselves, the portion of the population granted these rights has expanded over time. The United States is generally given high [5] to fair [6] marks on human rights. For example, the Freedom in the World index whose publisher Freedom House receives substantial funding from the US government [7] lists the United States in the highest category for human freedom in civil and political rights, with 86 out of points. Despite the fair to high rankings in reports on human rights, the United States also receives significant international criticism for its human rights record.

While both international human rights law and constitutional law protect fundamental rights of individuals, it remains a question to what extent and for what purpose constitutional justice uses IHR instruments. This article offers empirical research on the use of IHR instruments with a case study of South Korea. Quantitative and qualitative analyses were conducted for all sixty-five decisions from the Constitutional Court of Korea that mentioned IHR instruments from to Findings show that IHR instruments played a supportive but limited role in those decisions. In terms of their role in revoking domestic laws, IHR instruments were supportive but not conclusive in reaching final conclusions.

More countries declined than improved in overall rule of law performance for a third year in a row, continuing a negative slide toward weakening and stagnating rule of law around the world. The majority of countries showing deteriorating rule of law in the Index also declined in the previous year, demonstrating a persistent downward trend. This was particularly pronounced in the Index factor measuring Constraints on Government Powers. The declines were widespread and seen in all corners of the world. In every region, a majority of countries slipped backward or remained unchanged in their overall rule of law performance since the WJP Rule of Law Index. At a global level, countries experienced the biggest declines over the past year in the areas of Fundamental Rights 54 declined, 29 improved , Constraints on Government Powers 52 declined, 28 improved , and Absence of Corruption 51 declined, 26 improved.
